This Privacy Policy provides our clients and users (‘You’) with disclosure of how we may collect and make use of your information when you interact with us as a Company or from interacting and making use of our online platform:

(a)    at www.emergcare.com.au (Website);

(b)    via software (Software); and

(c)    using our applications (Apps);

to ensure the delivery of our services and goods to you in accordance with our Terms and Conditions (T&C’s).

Our commitment to you

We recognise the importance of protecting and maintaining your personal information. Any personal information that we collect or hold about you will only be used for the purpose for which we have collected it, or as allowed by law. We will take all reasonable steps to protect your personal information from unauthorised access, misuse, loss and unauthorised disclosure or modification.

We are committed to providing you with the highest quality professional service while protecting your privacy and abide by the legal requirements of the Australian Privacy Principles set out in the Privacy Act 1988 (Cth).

This policy outlines how we collect, use, store, and deal with your personal information.

Why we collect your personal information

We and our ISP that provides the hosting for the Website may collect personal information (including an opinion) when you use our site or communicate with us by electronic means and attend both our in-person face to face or online training and education sessions as well as for the provision of goods to you, including:

  • contact information – such as your name, geographical location, email address and telephone number, your browser’s and device’s characteristics and referring URLs;

  • site information – personal information you provide to our site and dates and times of site visits; and

  • biographical information – such as information about your background, medical history, education history, work history, and other relevant biographical information that may be considered.

Our current payment gateway provider is Stripe Payments Australia Pty Ltd ABN 66 160 180 343 with their site https://stripe.com/au. Our payment gateway provider for our Website may collect additional personal information when our Website forwards you to their payment gateway site to effect payment for our services and goods before re-directing you to our Website which may include a collection of your:

  • contact information – such as your name, geographical location, email address and telephone number, your browser’s and device’s characteristics and referring URLs;

  • financial information – such as your bank account details for the purchase of items related to our services and goods;

  • site information – personal information you provide to our site and dates and times of site visits;

and, only when and where, you have agreed to save any of your additional personal information as set out above, our payment gateway provider will generate a ‘Token’ for our Website to retain a reference to the retained information about your financial information by our payment gateway provider. We do not collect nor retain any records of your financial information that you may provide to our payment gateway provider.

We collect information by electronic collection methods, such as cookies and tags. A “cookie” is a text file that our site sends to your device to uniquely identify you or to store information or settings.  A “tag” links web pages to web servers and their cookies and may be used to transmit information collected to us. Your browser may notify you of these electronic collection methods and allow you to restrict or disable them. However, without them you may not be able to fully experience all our site’s features.

We also collect your personal information during the delivery of our services or for the provision of goods to you, including in providing information directly to us, using hardcopy or electronic forms, Software, Apps or Website, correspondences via email, when you interact directly with our employees, contractors, agents, affiliate, business affiliates or partner program, including Kidsafe and the Royal Children’s Hospital.

This Privacy Policy only covers the use of cookies by the Company. However, this Privacy Policy does not cover the use of cookies by any third-party site or advertisers that we may partner with and who may place their advertisement and links on our Website. You will need to make your own enquiry about the Privacy Policy of the third-party site or of our partner program site to better understand how they might use the data and information they may collect about you.

We may equally store your personal information in a secure filing system and secured environment and any electronic filing of your personal information are stored on an electronic document management system located at our business address location or by our partner program. Any other personal information that you have submitted to us by electronic means may also be stored by our domain host, email provider, backup service provider. These may be located overseas.

Your personal information is gathered and used for the purpose of enabling us to deliver to you our services and goods. Your personal information is retained to document what happens during our training and education sessions which in turn enables us and our Partner Program to provide you with relevant evidenced based and informed relevant training and educational courses as part of our ongoing improved services.

How do we use your personal information

We use the information we collect to:

  • provide you with a personalised experience with us, through our Software and Apps, and on our Website;

  • respond to and communicate with you about your requests, questions, and comments;

  • determine which areas and features are most popular, and to make improvements, updates to the site experience (including market and consumer research and trend analysis) and how we may tailor our site to better meet the needs of our users;

  • help diagnose technical and service issues;

  • operate and improve our business, for statistical and security purposes, analysing and enhancing our products, services, and site, developing new products and services, managing our business and marketing; and

  • provide services to you or by third party affiliates or partner program (which may only be used by them for the delivery of services and goods in line with the purpose that they are intended by us) where you are required to provide consent to this release and disclosure or that we are obliged by law.

Unless we provide you with specific notice, we will not use or disclose your personal information other than for the primary purpose for which it is collected as contained and disclosed in this Privacy Policy, unless you would reasonably expect us to use or disclose the information for a secondary purpose or your consent has been collected to use the information for additional purposes. 

Your personal information may be disclosed to employees, contractors, affiliates, and our partner program service provider for the primary purpose for which it is collected. By communicating with us, using our Software, Apps, and Website, you consent to this information being provided to the aforementioned.

Disclosure of personal information

Your personal information will remain confidential except when:

  • it is subpoenaed by a court, or disclosure is otherwise required or authorised by law; or

  • failure to disclose the information would in the Company’s reasonable belief, put property at risk, place you or another person at serious risk to life, health, or safety; or

  • your prior approval has been obtained to:

o   provide your data and information to our partner program and affiliates, e.g. Royal Children’s Hospital and Kidsafe;

o   discuss the material with another party, e.g. our third party affiliates, trainers, or partner program;

o   disclose the information in another way; or

o   disclose to another third-party (e.g. your GP) and disclosure of your personal information to that third party is for a purpose which is directly related to the primary purpose for which your personal information was collected.

Your personal information is not disclosed to overseas recipients by us unless you consent to it or such disclosure has been provided to you in this policy or is otherwise required by law. Your personal information will not be used, sold, rented or disclosed for any other purpose.

We will not disclose sensitive information unless it is necessary for us to conduct our business with you.  However, if you elect to provide us with unsolicited sensitive information, it may be retained.

Use of information to improve services

We may extract anonymous data records from your personal information that we have collected from you by excluding your identifiable information (such as your name) that would render the data generic or anonymous as well as not personally identifiable to you. We may use this anonymous data to prepare session materials, analyse consumer requests, produce reports that would be evidenced based information to better understand usage patterns so that we may enhance the content and delivery of our services and improve functionality. We may use anonymous data for any purpose and disclose anonymous data to third parties such as our partner program and affiliates at our sole discretion.

We adopt all relevant exemptions permitted under Australian Law in relation to employee records.

Use of information for marketing purposes

We may send you information and communications about our products and services that we consider may be of interest to you. We may send this in various forms, including mail, SMS, fax and email, in accordance with applicable laws, such as the Spam Act 2003. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

In addition, at any time you may opt-out of receiving marketing communications from us by contacting us by email or by using opt-out facilities provided in the marketing communications.  Please understand that if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions, and communications with us.

We equally rely on the use of remarketing services to advertise on third party websites (including, but not limited to, Google) to previous visitors to our Website. This means that we may advertise to you when you are accessing our website, including, through Google search results page, or a site in the Google Display Network.

For disclosure of how such third-party vendors, such as Google, may collect your date and information and use its cookies to serve advertisement based on your past visits, please refer to their respective privacy policy.

Your account information and details

If you have opted to be a registered user with us through our Website, Software and Apps and that you have supplied your email address, we may occasionally communicate with you by email to inform you about new features, seek your feedback, or just keep you up to date about our services and goods.

You are required to keep your personal information up to date and keep your login details such as your username and passwords secured. You are solely responsible for the details contained in your personalised account with us. You are responsible and liable for the use of your account with us. You are equally responsible and liable for any unauthorised use of your account by any third-party in the event of a breach of your login details being used and access to your account has taken place with or without your knowledge and permission as we do not keep records of your passwords.

We primarily use our blog to communicate this type of information, so we expect for you to keep your email address up to date as a minimum.

If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it to help us clarify or respond to your request or to help us support other users.

Third-party use of our information

Our website may contain links to third parties’ websites, software, and apps. We may obtain financial benefit by way of a referral commission which do not affect the pricing of our services or goods to you. These third-party sites are not subject to our privacy policy. You will need to review those sites to view a copy of their respective privacy policy.

These third-party sites may collect and use information regarding your use of our Website, Software, and Apps. Any personal information that you provide through our social media profile may be collected and used by other members of that medium and such interactions are governed by the respective privacy policy. We are not responsible, and we hold no control over how these organisations may use of your information.

Security and retention

Your data and information are held securely in hard copy form and electronic form at our business location.

We have put in place reasonable physical, electronic and management controls to keep information that we collect secure and protected from unauthorised disclosure or other access, misuse, interference, and loss. Due to the open nature of the Internet, the risks associated with storage and transmission of information electronically cannot be eliminated. We cannot offer any guarantee that all information will be free from unauthorized access by third parties and your use of the site acknowledges your assumption of this risk.

We will only retain your personal information for as long as is necessary to fulfill the purposes for which it was collected, including for satisfying any legal, accounting or reporting requirements or to comply with our data retention practices.

These requests will be responded to in writing within 14 days and an appointment will be made if necessary for clarification purposes. Depending on the type of request that you make, we may respond to your request immediately.

If we decline to correct your personal information, we will provide you with our reasons for not doing so.
